What is DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law enacted in 1998 that provides a legal framework for addressing claims of copyright infringement on digital platforms. The DMCA establishes a notice-and-takedown process that allows copyright holders to request the removal of infringing material from online services. It also protects service providers from liability when they act in good faith to remove or disable access to copyrighted content.

Under the DMCA, copyright holders can file formal takedown notices with website operators and hosting providers. These notices must meet specific legal requirements to be valid. The law also provides a counter-notification process for individuals who believe their content was wrongly removed. Both processes are designed to balance the rights of copyright holders with the protections available to website operators and content creators.

How to File a DMCA Takedown Notice

If you believe that content hosted on MyCalcBuddy infringes your copyright, you may submit a written DMCA takedown notice to our designated DMCA agent. Your notice must include all of the following elements to be considered valid under the law:

1. Your physical or electronic signature — You must sign the notice, either by hand or electronically, as the copyright owner or a person authorized to act on behalf of the owner.
2. Identification of the copyrighted work — Provide a clear description of the copyrighted material you claim has been infringed. If multiple works are involved, include a representative list.
3. Identification of the infringing material — Specify the exact location on MyCalcBuddy where the infringing material appears. Include the specific URL(s) or page descriptions so our team can locate the content quickly.
4. Your contact information — Provide your full name, mailing address, telephone number, and email address so we can respond to your notice.
5. Good faith statement — Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Accuracy and perjury statement — Include a statement that the information in the notice is accurate, and that you swear under penalty of perjury that you are the copyright owner or authorized to act on the owner's behalf.

How to Submit Your Notice

Send your completed DMCA takedown notice to our designated DMCA agent via our Contact page. Please include "DMCA Takedown Notice" in the subject line of your submission.

Once we receive your notice, our team will review it for completeness and validity. If the notice meets the DMCA requirements, we will take down or disable access to the alleged infringing material within a reasonable timeframe. We will also notify the user who posted the content about the takedown.

We aim to process all valid DMCA notices within 48 hours of receipt. In some cases, additional investigation may be required, which could extend the processing time. We will notify you if your notice requires additional information or clarification.

Counter-Notification Process

If your content was removed or disabled as a result of a DMCA takedown notice and you believe the removal was a mistake or misidentification, you may file a counter-notification with our designated DMCA agent. Your counter-notification must include all of the following elements:

1. Your physical or electronic signature — You must sign the counter-notification as the person whose content was removed.
2. Identification of the removed material — Describe the material that was removed and provide the location where it appeared before it was taken down.
3. Statement under penalty of perjury — Include a statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Consent to jurisdiction — Provide your name, address, and telephone number, and include a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located.

Upon receiving a valid counter-notification, we will forward a copy to the original complainant. The original complainant then has 10 to 14 business days to file a court action seeking to restrain the reinstatement of the material. If no court action is filed within that period, we may restore the removed content.

Repeat Infringer Policy

MyCalcBuddy maintains a strict policy regarding repeat infringers. In accordance with the DMCA and other applicable intellectual property laws, we will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or who has had content removed more than twice.

We reserve the right to determine, in our sole discretion, what constitutes repeat infringement. When we terminate an account under this policy, the user will be notified and will not be able to create a new account on MyCalcBuddy. We may also take additional measures as permitted by law.
